Terms of Service

These Terms govern your use of NovelForge (the "Service"), operated by an individual developer based in the Czech Republic. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. Users between 13 and 18 must have parental or legal guardian consent. If you are under 13, you may not use the Service.

2. The Service is provided "as is"

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at any particular time.

3. No uptime guarantee; service changes

We may modify, suspend, or discontinue the Service, or any part of it, at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service. Scheduled or unscheduled downtime, maintenance, or outages do not constitute a breach of these Terms.

4. You are responsible for your backups

You are solely responsible for maintaining backups of your manuscripts, Codex entries, and any other content you create or store in the Service. We are not responsible for any loss, corruption, or deletion of your data, whether caused by system failure, account termination, user error, or any other reason. The Service includes a backup feature; using it is your choice and responsibility.

5. Your content and license to us

You retain all ownership rights in your manuscripts, Codex entries, prompts, and any other content you submit to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely as necessary to operate, maintain, and improve the Service for you.

6. AI features and your responsibility

The Service may integrate third-party AI providers (OpenRouter, OpenAI, Google Gemini, Anthropic, and others). When you enable AI features, selected text and prompts are sent to your chosen provider. You are solely responsible for:

• The content of your prompts and any output you generate, edit, or publish;
• Ensuring your use of AI features complies with the provider's terms and acceptable-use policies;
• Any consequences arising from AI-generated content, including legal liability for defamatory, infringing, or unlawful material.

We do not review, endorse, or take responsibility for AI-generated output. AI output may be inaccurate, biased, or inappropriate; you must review it before publishing or sharing.

7. Prohibited uses

You may not use the Service to generate, store, or distribute any of the following, whether through AI features or otherwise:

• Child sexual abuse material (CSAM) or any content sexualizing minors;
• Terrorist content, or instructions for explosives, weapons, or mass harm;
• Defamatory, libellous, or fraudulent content about real people or entities;
• Instructions for manufacturing, selling, or distributing illegal drugs;
• Phishing, social engineering, or stolen credentials;
• Hate speech, harassment, or discrimination based on protected characteristics;
• Content that infringes another party's copyright, trademark, or other intellectual property;
• Malware, exploits, or instructions for cyberattacks;
• Stalking or doxxing instructions targeting real individuals;
• Non-consensual deepfakes or synthetic media of real persons;
• Medical misinformation likely to cause harm;
• Instructions or encouragement for self-harm or suicide;
• Any content that violates applicable Czech or EU law.

We may suspend or terminate any account that violates this section, with or without notice, and may preserve or disclose content to law enforcement when required by law.

8. Indemnification

You agree to indemnify and hold harmless the operator of NovelForge from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your Content or your use of the Service;
• Your use of AI features, including any output you generate or publish;
• Your violation of these Terms or any third-party rights;
• Your violation of applicable law.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the operator of NovelForge be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to the Service, whether based on warranty, contract, tort (including negligence), or any other theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount, if any, you paid us in the three months preceding the claim, or EUR 50, whichever is greater.

10. No professional advice

The Service is a writing and creative tool. Content generated through the Service, including AI output, is not legal, medical, financial, or professional advice. Always consult a qualified professional before acting on any information produced by the Service.

11. Third-party services

The Service integrates with third-party AI providers, email providers, storage providers, and error-monitoring services. Your use of these third-party services is subject to their terms and privacy policies. We are not responsible for their actions or omissions.

12. Export compliance

You may not use the Service if you are located in a country subject to EU, UN, or US sanctions, or if you are on any EU or US restricted-party list. You are responsible for ensuring your use complies with applicable export laws.

13. Account termination

You may delete your account at any time in-app. We may suspend or terminate your account, or restrict access to the Service, at our sole discretion, with or without notice, for any reason including violation of these Terms, inactivity, or to protect the Service or other users.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the competent courts of the Czech Republic. To the extent permitted by applicable law, you waive any right to participate in a class-action lawsuit or class-wide arbitration.
